You Need an Enduring Power of Attorney
Lawyers are often told by clients that they understand that they need an Enduring Power of Attorney (EPA) but that they don’t need it now.
Well here is the good news – you need it now not later when it might be all too late.
We just can’t go through life denying our mortality and human frailty.
There are those in the community who think that Enduring Power of Attorney’s are for the elderly who may be suffering from health issues such as dementia.
Well just consider the case of a young person severely injured in a motor vehicle accident – that person has as much need for an Enduring Power of Attorney as an elderly person. Perhaps it might be more correct to say that it is the family of the young person who have need of the EPA.
Just as having a current Will, an Enduring Power of Attorney is a selfless act which benefits your loved ones.
Having a current Enduring Power of Attorney is essential for the elderly. Aged Care facilities and Nursing Homes have a requirement for an EPA to exist as an entry requirement to their facilities.
When a person loses capacity and does not have an Enduring Power of Attorney in place, then their options are limited and mostly unattractive. Unnecessary costs will generally be payable and your financial and personal affairs could be administered by a Public Service.
The decision to make an Enduring Power of Attorney is a no brainer – you simply MUST HAVE AN ENDURING POWER OF ATTORNEY.
